Summary of Policy

This policy provides guidelines for the appeal of citations issued for the violation of regulations while parked on Dartmouth College property and the response to appeals by Transportation Services.

Policy Statement

When joining Dartmouth students and employees agree to follow parking rules established by the college. These rules apply to visitors and those conducting business on campus as well (e.g. contractors, vendors and service providers).

There could be an instance when a constituent believes they have properly followed parking rules and wish to file an appeal with Transportation Services after receiving a parking citation.

Establishing Appeal Parameters and Process

1. Appeals may be granted for the following valid reasons:

  • There is substantial evidence that a parking rules violation was not committed, or;
  • The parking violation was committed, but circumstances not under control of the recipient led to a violation, and before receiving the citation, a demonstrable attempt to notify Transportation Services occurred

2. Filing an appeal

  • Appeals are only accepted at Transportation Services online parking portal. The address is parking.dartmouth.edu.
  • A kiosk is also available to submit an appeal, located in the Transportation Services office on the lower level of 1953 Commons, for those with limited computer access or otherwise need filing assistance.
  • Transportation Services must receive a citation appeal within 14 days from the issue date.
  • Required information to accompany appeals
  • Incident description including when, where, how, and/or why it occurred.
  • Attached documentation of extenuating circumstances if cited in incident description (e.g., accident reports, medical records, auto repair bills).
  • Attached photo, map, or diagram of the parking space/area in question, if cited in incident description.

3. Appeal Review

A. Transportation Services staff will conduct the review. Individuals whose appeal falls outside of valid reasons as detailed in Section 1, will receive an email stating their appeal is denied.

  • Examples include, but are not limited to:
    • Not knowing the parking rules
    • Disagreement with fines
    • Inability to pay fines
    • Forgetfulness
    • Needing to park for a short period of time
    • Inability to find a parking space
    • Incorrect permit
    • Failure to obtain a temporary permit
    • Failure to notice parking signs
    • Failure to display a parking permit
    • Citation received by other than owner

B. When an appeal falls under parameters established in section 1, and any required documentation is provided, Transportation Services will take circumstances into consideration when deciding an appeal.

  • Circumstance examples include, but are not limited to:
    • Seriousness of violation
    • Previous citation history
    • Citation result of a complaint
    • Photos taken at time of citation
    • Current registration status

C. There are three possible appeal outcomes:

  • Warned/Void: The parking citation penalty is waived and there is no further accountability.
  • Reduced: There remains responsibility for the parking citation penalty, but Transportation Services expects payment of a reduced amount.
  • Denied: There remains responsibility for the parking citation penalty, and Transportation Services expects payment of the full amount and could incur additional late fees.

Ramifications

Vehicles that do not park in compliance with Dartmouth policy may be ticketed, booted or towed at the owner's expense. Collections referral, automatic transfer to student accounts, check-in suspension and the revocation of parking privileges may also occur. Failure to follow Dartmouth parking rules can lead to disciplinary action.
